These Terms & Conditions (“Terms”) govern your access to and use of the ASI Dynamics website, services, and firearms training programs. By accessing this website, enrolling in training, making payment, or attending any course or event, you agree to be bound by these Terms. If you do not agree to these Terms, do not use this website or participate in any ASI Dynamics activities.
1. Definitions
- “ASI Dynamics,” “Company,” or “Instructor” refers to ASI Dynamics LLC and all past, present, and future owners, members, managers, officers, directors, employees, agents, contractors, assistants, volunteers, insurers, successors, and assigns.
- “Student,” “You,” or “Participant” refers to any individual accessing the website, enrolling in, paying for, or attending instruction or training.
- “Premises” includes any shooting range, building, land, or location where ASI Dynamics instruction or activities occur.
2. Eligibility and Legal Compliance
By enrolling in or attending any ASI Dynamics course, you represent, warrant, and certify that:
- You are legally eligible under all applicable federal, state, and local laws to possess, handle, receive, and use firearms and ammunition.
- You are not prohibited from firearm possession or use due to conviction, pending charge, restraining or protective order, mental health adjudication, immigration status, or any other legal disability.
- No legal, physical, or medical condition exists that would prevent your safe participation in firearms or personal protection training.
You agree to immediately notify ASI Dynamics if you become prohibited at any time before or during participation. Any false statement, misrepresentation, or omission constitutes a material breach of these Terms and may result in removal without refund and referral to authorities.
3. Assumption of Risk
Firearms instruction, handling, and use involve inherent and significant risks, including serious bodily injury, death, and property damage.
By enrolling, attending, or participating in any ASI Dynamics activity, you knowingly, voluntarily, and expressly assume all risks—whether known or unknown, foreseeable or unforeseeable—arising from:
- Firearms instruction and training
- Handling, loading, unloading, or discharge of firearms
- Use of ammunition and related equipment
- Presence on or use of the Premises
4. Safety Rules and Conduct
All participants must strictly comply with all firearm safety rules and all verbal and written instructions provided by ASI Dynamics instructors, including but not limited to:
- Treat all firearms as loaded at all times
- Never point a firearm at anything you do not intend to harm or destroy
- Keep your finger outside the trigger guard until ready to discharge
- Positively identify the target, backstop, and areas beyond and between the target
Failure to comply constitutes a material breach of these Terms and may result in immediate removal from the Premises without refund.
5. Lesson Package Use & Validity
Lesson packages are designed to promote consistent training, skill development, and measurable progress. To achieve optimal results, packages are structured for weekly or biweekly training and are not intended for sporadic or infrequent use.
5.1 Package Validity
Lesson packages are subject to the following validity periods beginning on the date of the first scheduled session:
- 3-Lesson Packages: valid for 6 weeks
- 5-Lesson Packages: valid for 10 weeks
5.2 Expiration of Sessions
Any session not used within the applicable validity period will expire automatically and are non-refundable. No credit will be issued for unused or expired sessions.
5.3 Scheduling & Attendance
Students are responsible for scheduling their sessions within the package validity period. Advance scheduling is strongly encouraged to maintain training continuity and instructor availability.
Infrequent attendance may negatively impact training outcomes and instructor availability.
5.4 Extensions & Exceptions
Extensions to a package validity period are not guaranteed and may be granted solely at the instructor’s discretion in cases of instructor-approved circumstances. Any approved extension must be documented in writing.
5.5 Transferability
Lesson packages are non-transferable and may only be used by the individual(s) listed at the time of purchase.
5.6 Acknowledgement
Purchase of a lesson package constitutes acknowledgement and acceptance of these Terms & Conditions.
6. Scheduling, Cancellation, and Rescheduling Policy
ASI Dynamics maintains a strict scheduling policy due to limited instructor availability, range access, and logistical planning.
6.1 Advance Payment Requirement
Payment in full is required in advance as a condition precedent to confirmation and reservation of any appointment, lesson, or training session. No appointment shall be deemed confirmed, secured, or guaranteed unless and until payment has been received by ASI Dynamics.
6.2 Student-Initiated Cancellation or Rescheduling
- Cancellations or rescheduling requests must be made no later than 12:00 PM (noon) on the day prior to the scheduled lesson.
- Failure to provide timely notice, including late cancellations or no-shows, will result in forfeiture of all fees paid, with no refund or credit.
- If a lesson is rescheduled prior to the cancellation deadline, payment may be credited toward a future lesson.
- Any credited lesson must be used within thirty (30) days from the originally rescheduled date.
- All credits are non-transferable and may not be redeemed for cash or refunds.
6.3 Weather-Related Cancellations
- Training may proceed in adverse weather conditions unless ASI Dynamics determines conditions are unsafe or impractical.
- Weather conditions that are uncomfortable but not unsafe do not qualify for a refund or credit.
- If ASI Dynamics cancels or postpones a lesson due to unsafe weather conditions, students will receive a reschedule credit for a future lesson. No cash refunds will be issued.
6.4 Instructor or Facility Cancellation
- ASI Dynamics reserves the right to cancel or reschedule instruction due to instructor unavailability, facility or range closure, equipment issues, or operational constraints.
- In such cases, the student’s sole remedy shall be a reschedule credit for a future lesson. No additional compensation, reimbursement, or damages shall be owed.
6.5 Force Majeure
ASI Dynamics shall not be liable for delay, cancellation, or failure to perform resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather, fire, flood, epidemic or pandemic, government order, war, civil disturbance, labor dispute, utility failure, range closure, or acts or omissions of third parties.
In the event of a force majeure occurrence, ASI Dynamics may cancel or reschedule affected instruction. The student’s sole remedy shall be a reschedule credit, subject to availability. No refunds or damages shall be provided.
7. Removal and No Refund Policy
ASI Dynamics reserves the right, in its sole discretion, to deny participation or remove any individual from training for safety violations, failure to follow instructions, false representations, reckless or negligent conduct, or disruptive behavior.
Removal under this section shall be without refund or credit.
8. Limitation of Liability
To the fullest extent permitted by law, ASI Dynamics shall not be liable for any injury, death, illness, property damage, loss, or expense arising out of or related to participation in training, presence on the Premises, or use of firearms, ammunition, or equipment.
9. Indemnification
You agree to defend, indemnify, and hold harmless ASI Dynamics from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your participation in training
- Your presence on or use of the Premises
- Your handling or discharge of firearms
- Your violation of these Terms or safety rules
- Any negligent, reckless, or unlawful act or omission by you
10. Separate Liability Waiver Required
Participation in ASI Dynamics training requires execution of a separate, standalone Liability Waiver and Release of Liability, which is incorporated by reference into these Terms.
Failure to execute the required waiver will result in denial of participation without obligation to provide services.
11. No Warranties
All services and instructions are provided “as is” and “as available,” without warranties of any kind, express or implied.
12. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the state in which ASI Dynamics LLC is organized, without regard to conflict-of-law principles. Venue shall lie exclusively in the appropriate courts of that jurisdiction.
14. Entire Agreement
These Terms, together with the separate Liability Waiver and any posted policies, constitute the entire agreement between you and ASI Dynamics regarding use of the website and participation in services.
